Earlier, the Justice Department dropped its case against former Trump administration National Security Advisor Mike Flynn. According to the Justice Department, the case against Flynn was dropped after a considered review of all the facts and circumstances including newly discovered and disclosed information.
But U.S. District Court Judge Emmet Sullivan did not immediately grant the DOJ’s motion to dismiss its case. Instead, he appointed a former federal judge to argue against the request, and submitted a schedule to allow third parties to submit arguments in the case.
Well, seems Flynn’s Attorney isn’t taking trash from no one as she filed an emergency writ of mandamus to the D.C. Circuit Court of Appeals seeking that the prosecution against Flynn be dismissed as the Justice Department has requested, and for Judge Emmet Sullivan to be taken off the case. Flynn’s lawyers had argued to the appeals court that Sullivan’s moves “reveal his plan to continue the case indefinitely, rubbing salt in General Flynn’s open wound from the Government’s misconduct and threatening him with criminal contempt.”
And now, the D.C. Court of appeals on Thursday ordered judge Sullivan to respond to a petition by Flynn for the charges against him to be thrown out.
